The following FITARA CIO authority statements apply:

OMB guidance shall require that

  • each CIO certify that IT investments are adequately implementing incremental development
  • each CIO approve the IT budget request

Post-FITARA, agencies…

  • (These duties are not delegable unless otherwise specified)
  • May not request the reprogramming of any funds made available for IT programs, unless the request has been reviewed and approved by the CIO of the agency; and
  • May not enter into a contract or other agreement for IT or IT services, unless the contract or other agreement has been reviewed and approved by the CIO of the agency
    • agencies may delegate this approval for non-major investments to an individual who reports directly to the CIO
    • [However, agency] may use the governance processes of the agency to approve such a contract or other agreement if the CIO of the agency is included as a full participant in the governance processes.

Other Authorities

  • CIO shall approve the appointment of any other employee with the title of CIO, or who functions in the capacity of a CIO, for any component organization within the covered agency.”
  • Head of each non-DOD agency shall ensure that the CIO of the agency has a significant role in—
    • the decision processes for all annual and multi-year planning, programming, budgeting, and execution decisions, related reporting requirements, and reports related to IT; and
    • the management, governance and oversight processes related to IT.
